California continues to refine its strict security deposit laws. While previous updates restricted the maximum allowable security deposit to one month's rent for most unfurnished properties, current mandates focus on modernizing and tightening the return process.
Electronic Returns and Roommates: Landlords are legally permitted to return security deposits electronically if requested by the tenant. However, for multi-tenant agreements or roommates, the law requires the balance to be issued via a single check payable to all adult tenants on the lease, unless a different written agreement is signed by all parties.
The 21-Day Deadline: You still have exactly 21 calendar days after a tenant vacates to provide a fully itemized statement of any deductions along with the remaining funds. Failing to follow these structural logistics or withholding money for normal wear-and-tear can trigger "bad faith" penalties in small claims court, costing up to twice the amount of the original deposit.
3. State Rules vs. Local LA County Ordinances
A common mistake small landlords make is assuming that state law is the final word. In Los Angeles County, local jurisdictions frequently implement rules that overrule state relaxed caps.
